Terms of Service

By accessing or using the DAIMN website (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site. These Terms form a binding agreement between you and DAIMN ("DAIMN", "we", "us", "our").

You must be at least 13 years old to create an account or submit a join application. If you are under 18 (or the age of majority in your state), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information and keep it up to date.
• We may suspend or terminate accounts that violate these Terms or harm the community.

You agree not to:

• Use the Site for anything unlawful, harmful, or abusive.
• Harass, threaten, or impersonate other users, members, or staff.
• Attempt to access another user's account, private data, or restricted areas of the Site.
• Scrape, crawl, or bulk-collect content or data from the Site without permission.
• Interfere with the Site's operation, security, or infrastructure.
• Submit false, misleading, or fraudulent information in join applications.

Submitting an application to join DAIMN does not guarantee acceptance, roster placement, compensation, or any relationship with DAIMN. Applications are reviewed at our discretion, and decisions are final. Any team, creator, or competitive relationship that follows an accepted application will be governed by a separate written agreement.

The DAIMN name, the horned-skull emblem, the DAIMN wordmark, the slogan "MAKE THE LITTLE GUY THE BIG GUY", and all Site content, design, and artwork are owned by or licensed to DAIMN and protected by trademark, copyright, and other intellectual property laws. You may not use, reproduce, or distribute them without our prior written permission — except for sharing links to the Site or reasonable fair use.

You retain ownership of content you submit (such as application answers and profile details). By submitting content, you grant DAIMN a non-exclusive, worldwide, royalty-free license to use, store, and display that content as needed to operate the Site and review your application. You represent that you have the right to submit anything you send us.

The Ask DAIMN assistant generates answers using an AI model based on the Site's current information. Answers may be incomplete or inaccurate and are provided for convenience only — they are not official statements, offers, or commitments by DAIMN.

The Site may link to third-party services, including our external merchandise store and social platforms. We are not responsible for the content, policies, or practices of third parties. Purchases made through the external store are governed by that store's own terms and policies.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAIMN AND ITS MEMBERS, OFFICERS, AND STAFF WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

You agree to indemnify and hold harmless DAIMN from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

These Terms and any dispute arising from or relating to them or the Site are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

You agree that any legal action or proceeding relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction and venue of those courts.

We may update these Terms as the Site evolves. When we do, we will update the "Last updated" date above. Continued use of the Site after changes take effect means you accept the updated Terms.
